Privacy Policy

1. Who we are

This Privacy Policy describes how Emojico, Inc., doing business as Potential Commerce (“Potential Commerce,” “we,” “us,” or “our”), collects, uses, and shares information when you visit our website at potentialcommerce.com or use our Ads Performance Center application (“the Service”).

2. Information we collect

Information you provide directly. When you join our waitlist, sign up for the Service, or contact us, we collect information you submit, such as your name, email address, business name, and any messages you send us.

Information from your Shopify store.When you connect your Shopify store to Ads Performance Center, we access reporting data through Shopify’s APIs to deliver the Service. This includes business metrics such as orders, gross sales, discounts, refunds, net sales, net profit, and campaign-linked commerce aggregates. The Service is designed to operate from normalized reporting data and workflow context rather than raw customer records or full source-system payloads. We do not persist raw Shopify customer records or raw Shopify order records as application records for normal Ads Performance Center use.

Information from your Meta advertising account.When you connect your Meta advertising account to Ads Performance Center, we access reporting data through Meta’s Marketing API. This includes campaign, ad set, and ad-level metrics such as spend, impressions, clicks, CPM, CPC, CTR, add-to-cart counts, checkout counts, purchase counts, sales, and ROAS, along with associated identifiers and names. We do not collect personal information about individual users who saw or clicked your ads.

Configuration and workflow context. We store the configuration you create within the Service, including saved views, selected campaigns, goals, filters, and other operator-chosen reporting context.

Information collected automatically. When you visit our website or use the Service, we collect technical and operational metadata including IP address, browser type, device information, pages visited, referring URLs, and information needed to operate, secure, and troubleshoot the Service. We use cookies and similar technologies for authentication, security, analytics, and remembering your preferences.

3. How we use information

We use the information we collect to:

  • Operate, maintain, and secure the Service
  • Connect with Shopify, Meta, and other supported platforms
  • Generate reports, performance summaries, and workflow outputs
  • Support AI-assisted analysis and recommendations
  • Communicate with you about your account, the Service, and product updates
  • Respond to your inquiries and provide customer support
  • Troubleshoot errors, monitor reliability, and improve service operations
  • Comply with legal obligations, platform obligations, and contractual requirements

We do not sell your business data in the ordinary meaning of that term. We do not use your business data to train general-purpose AI models for unrelated third-party use.

4. How we share information

We share information only as described below.

Service providers and subprocessors. We use third-party service providers to host infrastructure, process data on our behalf, and deliver AI-assisted capabilities. Current providers include:

  • Google Cloud, including Vertex AI, for hosted infrastructure and certain AI model processing
  • OpenAI, for GPT-based API processing when enabled in the product
  • Anthropic models made available through Google Cloud Vertex AI partner-model services, when enabled in the product

These providers process data on our behalf and under our instructions. We may add, change, or remove providers as the Service evolves.

Integration partners. Our Service connects to Shopify and Meta. Your use of those platforms is governed by their respective privacy policies and terms.

Legal requirements. We may disclose information when required by law, subpoena, court order, regulation, or platform obligation, or to protect the rights, property, or safety of Emojico, Inc., our users, or others.

Business transfers. If Emojico, Inc. is involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction, subject to appropriate confidentiality and legal controls. We will notify you before your information becomes subject to a different privacy policy.

5. AI processing and automated recommendations

A core feature of Ads Performance Center is generating analytical insights and recommendations using AI-assisted features. To do this, we send selected categories of business data to approved service providers that help process and return the requested analysis.

What we send to AI providers. Depending on the feature and selected workflow, we may send:

  • Shopify-derived business metrics such as orders, gross sales, discounts, refunds, net sales, net profit, and campaign-linked commerce aggregates
  • Meta-derived marketing metrics such as campaign, ad set, or ad identifiers and names, spend, impressions, clicks, CPM, CPC, CTR, add-to-cart counts, checkout counts, purchase counts, sales, and ROAS
  • Date ranges, selected campaign filters, reporting views, goal targets, operator preferences, and other working-set context needed to generate the requested output

We send normalized reporting data and workflow context, not raw platform credentials, raw webhook payloads, or full source-system data dumps. We do not send your business name or account identifiers as part of normal AI processing. We do not send Shopify or Meta access tokens, webhook signatures, OAuth codes, customer credentials, or full raw webhook payload bodies to AI providers as part of normal runtime analysis by default.

Provider retention and model training.We select business-oriented provider offerings and configurations designed to limit provider use of submitted data for general-purpose model training, subject to each provider’s applicable terms and technical controls. Provider retention behavior depends in part on the settings and commitments offered by each provider. Some providers may temporarily retain data for safety monitoring, abuse prevention, in-memory caching, or service reliability per their service terms.

Logging. We primarily log metadata about AI requests, such as provider, model, request timing, usage counts, and error status, to operate, secure, and troubleshoot the Service. We do not retain raw prompts or raw AI outputs in routine production application logs by default. If temporary content-level logging is required for debugging or incident response, it is limited in scope, access-controlled, and retained only as long as necessary.

Automated decision-making.Ads Performance Center generates recommendations (such as “scale this ad set” or “pause this campaign”) based on AI analysis. These are advisory recommendations only — you make the final decision on every action. The Service does not automatically execute changes to your ad accounts or store on your behalf without your explicit approval.

Your rights regarding AI processing. You can request information about how AI is used in your account, opt out of AI-generated recommendations (in which case the Service will function as a data viewer only), or request human review of any recommendation that significantly affects your business. 6. Deletion and privacy requests

We handle deletion and privacy-related requests in accordance with applicable law, platform obligations, and contractual commitments.

Shopify compliance webhooks.We implement Shopify’s mandatory privacy compliance webhook process for customer data access requests, customer redaction requests, and shop redaction requests. Shopify sends these requests to our privacy webhook endpoint, where we verify Shopify’s webhook signature before acting. Customer-level requests are acknowledged without retaining or returning raw customer contact information, because the Service does not persist raw Shopify customer records or raw Shopify order records as application records. Shop redaction requests delete tenant-owned app workspace data, disconnect platform access, and anonymize the shop identity in our application database.

What we delete on a shop redaction request. Shopify connection, Meta connection, selected Meta ad accounts, goals, saved views, current Ads Performance Center working state, saved insights and insight artifacts, presets, filters, and related workspace records.

What we may retain. We may retain limited records when reasonably necessary for accounting, billing, security, dispute resolution, fraud prevention, legal compliance, or audit purposes. Retained records are kept separate from active workspace data and are not used to continue providing the Service after a shop redaction request.

Direct requests. You can also request deletion at any time by contacting hello@potentialcommerce.com or by visiting our Data Deletion page for detailed instructions.

Deletion timing. We delete or anonymize active app workspace data after a valid Shopify shop redaction request, and we work to complete deletion from systems under our control within 30 days unless retention is required for security, legal, billing, dispute, audit, or backup-continuity reasons. Backup, log, support, analytics, and provider-retained data may follow separate retention periods depending on the applicable system, provider terms, and legal or operational requirements.

7. Your rights

Depending on your location, you may have the following rights:

  • Access: Request a copy of the personal information we hold about you.
  • Correction: Request that we correct inaccurate information.
  • Deletion: Request that we delete your information.
  • Portability: Request a copy of your data in a portable format.
  • Opt-out: Opt out of certain uses of your information.
  • Withdraw consent: Where processing is based on consent, withdraw it at any time.

California residents (CCPA/CPRA):You have the right to know what personal information we collect, request deletion, opt out of any “sale” or “sharing” of personal information (we do not sell or share personal information for cross-context behavioral advertising), and not be discriminated against for exercising these rights.

EU/UK residents (GDPR): You may also lodge a complaint with your local data protection authority.

8. Cookies and tracking

We use cookies and similar technologies to operate the Service, remember your login session, analyze usage, and improve the experience. You can control cookies through your browser settings. Disabling cookies may affect functionality.

We do not use third-party advertising cookies on our website.

9. Security

We use administrative, technical, and organizational measures intended to protect the security of the Service and the information it processes. These measures include encryption in transit (TLS), encrypted data storage, tenant-scoped access controls, authentication controls, least-privilege design, and operational logging for security and reliability purposes. No system is perfectly secure, and we cannot guarantee absolute security.

10. Children’s privacy

The Service is intended for businesses and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe we have collected such information, contact us and we will delete it.

11. International data transfers

Emojico, Inc. is based in the United States. If you access the Service from outside the U.S., your information may be transferred to, stored, and processed in the U.S. By using the Service, you consent to this transfer. Where required by law, we use appropriate safeguards (such as Standard Contractual Clauses) for international transfers.

12. Third-party platforms

The Service integrates with Shopify and Meta. Information you provide to those platforms is governed by their respective privacy policies:

We are not responsible for the practices of these third-party platforms.

13. Changes to this policy

We may update this Privacy Policy from time to time to reflect changes in the Service, provider configuration, legal requirements, or data-handling practices. If we make material changes, we will notify you by email or through the Service. The “Last updated” date at the top reflects the latest version.
